Masters And W Orkmen , Was Heard At The ...
masters and w orkmen , was heard at the Leeds Court House , on Wednesd ay week , before the Mayor and several of tho Magistrates . Messrs . Joshua Bower and Son , plate glass manufacturers , Ilunslet , were thc plaintiffs , and a person who was lately a workman of theirs , named Benjamin Briggs , was thc defendant . The charge against Briggs was that of h a vin g absente d h ims e lf fr o m his masters ' employment , without their consent , and contrary to a contract he had entered into . Mr . Sangster , solicitor , appeared on behalf of Messrs . Bower , and Mr . Sanderson , solicitor , for Briggs . —The contract alleged to have been broken was put in by Mr . Sangster , and
from that document , it appeared that on 20 th Marcu , 15-12 , Briggs entered into an agreement with Messrs . Bower , for a period of seven years , receiving at tlio time os . as hiring money . The rate of wages to ho paid to Briggs was to bc 24 s . a week , and -Id . a dozen over work when blowing , and 20 s . a week when gathering , and 3 d . a dozen over-work , besides being provided with a house oil tho promises , or , in lieu thereof , to bc allowed £ i a year additional . By tho contract a power was given to the Messrs . Bower oi : dispensing with the services of Briggs , by giving him a month's notice , or a month ' s wages , but no power whatever was given to the man to release himself from thc agreement . It scemeel that , contrary lo the terms of this contract , Briggs , on the llthol
July last , refused to continue to perforin the services lie had engaged to do , and subsequently left'the town , and against such conduct Mr . Sangster said it was the object of Messrs . Bower , in the present proceeding , to seek a le g al remed y , as they employed a great num b er o f men , and had " _suflbrod seriously in consequence of their absenting themselves from their employment . The statutes under which he proposed that the case should be taken were thc 20 th _Ceoi'L'O II ., the 0 th George III ., and the 4 th George IV ., all of which , he believed , would apply , anil if so , lie called upon the magistrates to award tlio punishment due to the offence . —Mr . Sanderson admitted the signing of the contract , an d thc runnin g away from employment , but in reference to the act Gth _tieorse
111 ., he argued that it could not be applicable in such a case as the present , because it onlv enabled the justices to act where the defaulting" parties wero found , and Briggs was found at St . Helen's , in Lancashire . Therefore the onlv power of the teneli would be under 4 th George IV . This position being allowed , Mr . Sanderson cross-examined Mr . Joshua Bower ( whois an _Alelerman-of thc _borough ot _Lcetls ) , with a view lo elicit that Ii rings yot what is called a "clearance , " or , in other words , had notice given to leave his employment by Mr . Bower , at a period in 18-12 when work was slack . This Mr . Bower did not confirm . He admitted that he and Briggs , at the time the latter left liis employment , had a dispute about gathering , and that _Briscs said he would leave liis work rather than do it , _buiThc denied that lie had ordered him to do more than his share in gathering .
Mr . Sanderson next took an objection to the contract , under the act 1 st and 2 nd George IV ., chap , ol , which prohibits contracting for the payment of the wages of any artificer ( enumerating glass makers amongst others ) in anything other than tho current coin of the realm , and declares that if cither tho whole or part of an artificer ' s wages shall bo paid in any other manner , that thc contract shall bc illegal , and null and void , He submitted that iu the remuneration of Briggs , one of tlie _ingredients was clearly the occupation of a dwelling-house , and that it was fatal to the contract . — -Mr . Sangster declared he had never heard such a construction of tho act , and he believed that no such construction had been acted upon . Ho contended that it was a solitary clause intended merely to prevent the payment of servants in goods . It was , he observed , in _' many trades absolutely necessary that houses sliould bc found for
servants to live in on the premises , and that it was no more applicable in this instance than whore a servant resided in the house of his master , in which ease ho of course received less wages . In fact , the clause entirely related to the truck system and nothing else—After a short consultation the Mayor announced the decision of tho Magistrates us follows : — " _H'C case is ono of considerable _dillieulty . There aro many points which require the attention of the justices , but now , as on the former occasion , wedo not think we should bo justified in convicting in tins c ase , the more especially as Mr . Bower has his jcmedy , and no doubt will avail himself ol it . — Another case of a very similar nature was afterwards taken , in which Messrs . Bower and Son were tic plaintiffs , and a man named John Maeauley ( fflio had been brought from St , Helen ' s , in custody along with _Jlriggs ) was the defendant .
